Submitting Rules
No purchase necessary, all the submissions are moderated and approved by House Of Gems Inc. (dba www.houseofgems.com) social media team and in house staff members.
Who may submit: Submissions open only to community members who are at least 18 years of age at the time of entry and who are new and registered community members with valid email and physical address. Submissions subject to and not limited to Privacy Policy and Terms of Use of House Of Gems Inc. (DBA www.houseofgems.com).
Moderator: House of gems Inc. (DBA www.houseofgems.com) staff members and approved parties moderates the content.
Binding agreement: Participation in this community and submitting entries constitutes full and unconditional acceptance of official community submitting rules which are final and binding. Therefore please read the official rules before submitting your entry. You may not submit an entry to the community and are not eligible unless you agree to these Rules.
How to Submit:
To submit an entry via the digital upload tool on the Community Site, please follow the instructions. House Of Gems Inc. is not responsible for illegible or incorrectly submitted entries made via the digital upload tool.
Log in to your account
Name the project (example: night sky blue necklace, how to make blooming flower earrings).
Write description about the submitted work such as what inspired you to make it, story behind, your experience with that particular project and anything you want to say about your work.
If you want to provide instruction please do so to help someone learn.
Check proper box (example: video, photo) and attach your work and submit.
Entry must be the original work and owned by the person who is submitting. May not have been previously published, must not infringe upon the copyrights, trademarks, rights of privacy, publicity or other intellectual property or other rights of any person and must not violate any law. Moderator reserves the right to disqualify any entry for any reason, in its sole and absolute discretion. All entries becomes the property of House Of Gems Inc. (DBA www.houseofgems.com) will not be returned or acknowledged.
Criteria: Each submission will be evaluated and posted based on the following “Criteria”. 1) Artistic merit 2) Creativity and originality 3) Skills 4) Functionality 5) Design 6) Theme 7) Use of material. Moderator decision is final and binding.
Notification to submitters: No notification will be send to the submitting person or company.
General Conditions: Submitters constitutes permission of their entries (except where prohibited by law) to use their name, images, likeness (all at moderator discretion) for future advertising, publicity in any and all media now or hereafter devised throughout the world in perpetuity, without any compensation, notification or permission. Moderator (House Of Gems Inc. dba www.houseofgems.com) and their respective officers, directors, agents, representatives, and employees (collectively, “Released Parties”) are not responsible for lost, late, misdirected, damaged, stolen, altered, garbled, incorrect, incomplete or delayed submissions ; all of which will be void. Released Parties are also not responsible for problems related to technical malfunctions of electronic equipment, computer online systems, servers, or providers, computer hardware or software failures, phone lines, failure of any Entry to be received by House Of Gems Inc. on account of technical problems, traffic, congestion on the internet or the website, or for any other technical problems including telecommunication, miscommunication or failure, and failed, lost, delayed, incomplete, garbled, or misdirected communications which may limit a contestant’s ability to participate in this community summation entries. Released Parties are not responsible for any other errors or malfunctions of any kind, whether network, printing, typographical, human or otherwise relating to or in connection with the community or submission, including, without limitation, errors or malfunctions with may occur in connection with the administration of the community website, the processing or moderating of entries, in any related materials. Mass entries generated by a script, macro or use of automated devices will be disqualified. House Of Gems Inc. reserves the right to modify, suspend or terminate the submissions in the event it becomes infected by a computer virus or is otherwise technically impaired, and to cancel or suspend the submission in its entirety should tampering, unauthorized intervention, fraud, technical failures or other causes corrupt the administration, security, fairness, integrity or proper play of the submission and, if terminated, at House Of Gems Inc. discretion, determine the all non-suspect, eligible entries received up to time of cancellation using the moderating procedure outlined above. In the event of a dispute regarding submissions received from multiple users having the same email account, the authorized subscriber of the email account at the time of submission will be deemed to be the submitter and must comply with these Official Rules. Authorized subscriber is the natural person who is assigned the email address by the Internet Service Provider (ISP), online service provider, or other organization responsible for assigning email addresses. House Of Gems Inc. reserves the right at its sole discretion to disqualify any individual (and void his/her Entries)) it finds to be tampering with the submitting process or the operation of this community or website, intending to annoy, abuse, threaten or harass any other community members, moderator, or any of its representatives or to otherwise be acting in violation of these Official Rules. CAUTION: Any attempt by a community member to deliberately damage any website or undermine the legitimate operations of the community website is a violation of criminal and civil laws. Should such an attempt be made, the House Of Gems Inc. (dba www.houseofgems.com) reserves the right to seek damages from any such member to the fullest extent permitted by the law and to disqualify such member from the community.
Assignment of rights: Entrant hereby acknowledges that Entry and all other materials of every kind whatsoever created by community member relating to the community (collectively, the “Work”) are a “work made for hire” (as that term is used in the United States Copyright Act) for moderator, and assigns to moderator (or, if any applicable law prohibits or restricts such assignment, submitting person hereby grants to moderator an irrevocable, perpetual, royalty-free, transferable license of) limited right, title and interest in and to such Work, including, without limitation, all rights of every kind and nature (whether now known or hereafter devised, including all copyrights therein and thereto and all renewals and extensions thereof), throughout the universe, in perpetuity, for all purposes, in any and all media, whether now known or hereafter devised. By submitting an Entry, submitter acknowledges and agrees that moderator may obtain many submissions under this community submission and that such entries may be similar or identical in theme, idea, format or other respects to others submissions under this community participation and/or other submitter staged and/or waive any and all claims community may have had, may have, and/or may have in the future, that any composition, design, video and/or other works accepted, reviewed and/or used by the moderator (or its respective designees) may be similar to his/her Entry. Submitter acknowledges and agrees that the Sponsor does not have now, nor shall any of them have in the future, any duty or liability, direct or indirect, vicarious, contributory, or otherwise, with respect to the infringement or protection of any copyright in and to submitter’s entry.
Right to disqualify, Cancel, Modify: If for any reason the community is not capable of running as planned, including infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, or any other causes which corrupt or affect the administration, security, fairness, integrity, or proper conduct of the community, House Of Gems Inc. reserves the right at its sole discretion to cancel, terminate, modify or suspend the community. Further reserves the right to disqualify any Entrant who tampers with the submission process or any other part of the community or community Site. Any attempt by an Entrant to deliberately damage any web site, including the community Site, or undermine the legitimate operation of the community is a violation of criminal and civil laws and should such an attempt be made, House Of Gems Inc. reserves the right to seek damages from any such Entrant to the fullest extent of the applicable law.
Attribution: By entering the community, you agree that exclusive jurisdiction for any dispute, claim, or demand related in any way to the community will be decided by binding arbitration. All disputes between you and House of Gems Inc. of whatsoever kind or nature arising out of these Rules, shall be submitted to Judicial Arbitration and Mediation Services, Inc. (“JAMS”) for binding arbitration under its rules then in effect in the Orange County, California, USA area, before one arbitrator to be mutually agreed upon by both parties. The parties agree to share equally in the arbitration costs incurred.
